1.1. . These Terms of Service ("Terms") govern the "Vaidyanaari" mobile application ("Vaidyanaari App") and all services provided through the Vaidyanaari App and website (collectively referred to as "Vaidyanaari Services"). The terms "we," "us," and "our" refer to Vaidyanaari.
1.2. In addition to these Terms, our Privacy Policy (available at https://vaidyanaari.app/policy) details your and our respective rights and obligations regarding data protection, including the processing of sensitive health data.
1.3. Vaidyanaari Services empower women by offering insights into menstrual, reproductive, and overall well-being from menarche to menopause. The app enables users to track changes in their bodies, recognize patterns, and gain knowledge about their health. It is a mobile-based application constantly evolving with new features designed to support different life stages. General information about the app and various aspects of menstrual and reproductive health is available on our website. The scope of our services is detailed in § 4 of these Terms.
1.4. To use Vaidyanaari's Paid Services (§ 6), you must be at least 18 years old. If a minor uses our Paid Services, it is assumed that their parent or legal guardian has provided consent. This consent is obtained when an account is created before the minor first uses the app. The guardian assumes full responsibility for the minor's use of paid services.

2.1. By using Vaidyanaari Services, you agree to these Terms.
2.2. If we make material changes to these Terms that affect Paid Services (§ 6), we will request your consent. Material changes include modifications to the type, scope, duration, or termination of paid contracts. However, we reserve the right to enhance our services or introduce new features within the Paid Services.
2.3. We may implement non-material changes to these Terms at any time without notice. No oral or written agreements exist outside these Terms.

3.1. Vaidyanaari is not a substitute for medical advice. Consult a qualified healthcare professional for any health concerns.
3.2. Use of Vaidyanaari Services is at your own risk. Our platform does not diagnose, treat, or manage medical conditions. If you experience physical or emotional distress from using Vaidyanaari, discontinue use and seek medical help. If you have any concerns or feedback, you can contact our Support team through the app.

4.1. Vaidyanaari provides comprehensive information on menstrual and reproductive health. The app allows users to log menstrual cycles, physical activity, health conditions, pregnancy status, and other relevant data. These entries enable statistical and algorithmic processing to help users identify trends in their cycles or pregnancies.
4.2. Vaidyanaari is a self-management tool based on user-provided data. The accuracy and usefulness of insights depend on the quality and consistency of the data recorded by the user.
4.3. Vaidyanaari is available on iOS and Android in two forms: (a) With an account (registered users): Data is stored both locally and on our servers, allowing multi-device access. (b) Without an account: Previously available as a local service but no longer offered to new users.
4.4. The basic version of Vaidyanaari is free, with additional features available through Paid Services (§ 6). The app can be downloaded from the Apple App Store (iOS) or Google Play Store (Android).
4.5. We may display advertisements in the app and on our website or offer users the option to donate to support our mission.

5.1. A Vaidyanaari account is required to access our services. To create an account, you must accept these Terms and consent to data processing under our Privacy Policy. You will need to provide a username, email, and password. Additional onboarding details may be required for a personalized experience. Account creation is completed upon confirmation via email.
5.2. You may also register using Apple, Google, or Facebook credentials.
5.3. You are responsible for providing accurate information and securing your account using authentication measures such as PIN, Face ID, or Touch ID.
5.4. We reserve the right to refuse account creation or deactivate accounts that interfere with Vaidyanaari Services.

6.1. You may not transfer your account to third parties. Vaidyanaari is for personal use only unless otherwise agreed in writing.
6.2. Users are prohibited from: Sharing authentication details with third parties. Bypassing paid service access controls. Removing or obscuring copyright or intellectual property notices. Transferring rights or obligations under these Terms to others.
6.3. Users must comply with agreements with their internet provider and app store operator.
6.4. Regular app updates are required for optimal functionality. Automatic updates may be installed without prior notice to enhance the service.

7.1. All content in the Vaidyanaari App and website is protected by copyright laws.
7.2. Using Vaidyanaari Services does not grant you ownership rights. You may not modify, distribute, or commercially exploit our content.
7.3. We collect anonymous data to improve our services and support research, as outlined in our Privacy Policy.

8.1. While we strive to provide accurate content, we do not guarantee completeness or correctness. Users are responsible for the security of their personal data.
8.2. Vaidyanaari does not guarantee specific outcomes such as accurate cycle predictions.
8.3. Our recommendations are general and not intended as medical advice. Consult a healthcare provider if uncertain.
8.4. Liability is limited to damages caused by intentional or gross negligence, breach of fundamental contractual obligations, or as required by law.

9.1. Free service users can delete their accounts at any time.
9.2. Paid Services are automatically renewed unless canceled at least 24 hours before the renewal date.
9.3. Subscription cancellations may need to be managed via the App Store or Google Play Store.
9.4. Both parties reserve the right to terminate the contract for valid reasons.

10.1. While we strive for uninterrupted service, we do not guarantee full availability at all times.
10.2. We may transfer our rights and obligations to a third party with prior notice. Users may terminate their contract within 14 days of such notification.
10.3. German law governs these Terms, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
10.4. Legal disputes will be settled in Berlin, Germany.
10.5. If any provision in these Terms is found to be invalid, the remaining provisions remain in effect.
10.6. Translations are provided for convenience; in case of discrepancies, the English version prevails.
